Law no. 379 of December 14, 2000, provides for the recognition of Italian citizenship in favor of persons born and residing in the territories of the former Austro-Hungarian Empire and their descendants who meet the necessary requirements.
The deadline for applications under Law 379/2000 expired on December 19, 2010.
Law no. 124 of March 8, 2006, provides for the recognition of Italian citizenship in favor of compatriots who lost it due to residing from 1940 to 1947 in Istria, Fiume, and Dalmatia.
The recognition of Italian citizenship under special laws constitutes an acquisition by benefit of law. Therefore, it is not possible for the parent, who has acquired citizenship in this manner, to make the declaration of intent for the acquisition of citizenship on behalf of a minor child, as provided for in Article 4, paragraph 1-bis, of Law no. 91/1992, since the recognized parent is not an Italian citizen by birth.
